WHAT SHOULD YOU CONSIDER TO REGISTER A NATIONAL TRADEMARK AND EU TRADEMARK?

Applying for a trademark registration is a very simple procedure, although there are several very important aspects that must be considered before starting the application:

OWNERSHIP AND RIGHTS

The owner or owners of a trademark will be the natural or legal persons who will have the use and exclusivity rights of a trademark over a 10-year renewable period.

A trademark may be owned individually or collectively and, during the registration application, the ownership percentages of each owner will be determined and documented.

TYPES OF TRADEMARKS

A trademark may consist of a word, an image, a sound or a combination of these elements. These elements are used to identify and differentiate the trademark from its competitors in the market.

Depending on the representation that identifies a trademark, there are several trademark types for which to request the protection that best suits your needs and strategy:

Marcas Tridimensionales

TERRITORIAL PROTECTION

One of the most important aspects to consider when registering a trademark is the territorial scope of its protection, both in the short and long term.

Based on the protection that best suits the use strategy of your trademark, you can apply for its registration as:

National Trademark: the scope of its protection extends in the national territory.

EU Trademark: includes trademark protection
across all 27 European Union
countries. With the EU trademark registration application you have access to trademark protection in all 27 countries by means of a single application which, once the trademark is registered, becomes a single title to market the trademark throughout the European territory.

NICE CLASSIFICATION

There are 45 classes of products and services that are used to classify the activity of a trademark.

When applying for registration, all trademarks must select
for which products or services they wish to obtain protection and exclusivity in the market.

This selection is made according to the business activity for which the trademark will be used, within the short, medium and long term business strategy.

This is a crucial decision, since once the trademark application has been processed, the products and services for which protection has been requested may not be modified.

Check the Nice Classification list and
find the class that best suits your
product or service and business strategy.

GRANTING PERIOD

In the case of the national trademark:

After the application is registered, the trademark is examined by the Spanish Patent and Trademark Office (SPTO), where they assess whether it meets the requirements necessary to be granted.

In the case of the EU trademark:

After the application is registered, the trademark is examined by the European Union Intellectual Property Office (EUIPO), where they assess whether it meets the requirements necessary to be granted.

WHAT DO YOU NEED TO CONSIDER WHEN RENEWING
A NATIONAL AND EU TRADEMARK?

Trademark protection, both nationally and in the European Union, expires after ten years from the application date.

Once the ten years have expired, you may renew the trademark for an additional ten years, starting six months prior to the expiration date.

The renewal extends your exclusivity and use rights, and maintains its value and protection in the market.
